Terms and Conditions relating to the Wills Premium Service


The Which? Wills premium service ("Premium Service") will be provided to you under the following terms and conditions.

1. What we will do

We will provide you with the Document Preparation Service, a document assembly and drafting system to create a will document ("will"), in accordance with our terms and conditions for this service.

We will provide you with our Legal Review Service, a review of the answers that you provided when you used the Document Preparation Service, to check that the will you have created complies with required legal formalities for the will (once properly executed) to be acted upon in the future, in accordance with our terms and conditions for this service;

When the Legal Review has been completed, we will have your will printed and bound. We will use reasonable care and skill when providing the printing and binding services.

We will print your will:

  • in black and white;
  • on white paper.

We will bind your Will:

  • using a hot glue binding method;
  • inserting grey textured card with a window for a front cover; and
  • inserting grey textured card for a back cover

Your printed and bound document will be sent to the address you gave to us when registering to use the Document Preparation Service. Please ensure that you provide us with your correct address details when you complete the online registration form. Wills can be posted to any address; however the price includes postage to an address within the UK only. Where you require postage outside of the UK, we will provide you with a quote for the additional cost. Please note that our wills are not suitable if you live permanently outside of the UK.

It will usually be posted within seven working days of when we complete the Legal Review; however, at times of high demand it may take longer. If you haven't received your printed will within ten working days of when we complete the Legal Review, please send us a message using the 'Contact Us' function in your Which? Wills account.

Once your legal review service is completed by us, we will send you an email containing a link to enable you to register your Will and its whereabout with Certainty the National Wills Register. We recommend you only do this once your will has been signed and witnessed.

We may at our absolute discretion and for an additional fee provide the following additional services;

a replacement printed and bound copy of your will where you inform us that you have lost the will we sent to you;
a further printed and bound copy of your will corrected in accordance with your instructions, where you identify that the printed and bound will we sent to you contains errors made by you;
expedited Legal Review.
Please contact us if you require any of these additional services and we will confirm whether we will be able to provide them and the fee that would apply.

2. What you will need to do for us

You should read the terms and conditions that apply to the Document Preparation Service and the Legal Review before you start creating your will and follow all instructions we provide.

To create your will, you will be asked a series of questions and the answers you give will automatically generate the content of the will. It is essential that you provide the correct information (this includes information in relation to the identity of any parties or signatories, their age or capacity) and carefully check that the answers you give are accurate and fully reflect your wishes. When you click to submit your will for Legal Review, this is what we will send for printing and binding.

It is your responsibility to ensure that your will is properly executed in accordance with any instructions that are provided to you.

3. Paying for the Premium Service

Payment is due when you complete the Document Preparation Service process. Any additional service fees (for example an expedited Legal Review, and/or to provide a replacement or amended copy of your printed and bound will) are due at the time that additional service is requested/offered and a fee for providing the additional service(s) has been agreed.

4. Other important information


(i) Cancellation and refunds

You have the right to cancel this contract within 14 days without giving any reason. This cancellation period will expire 14 days after you make payment for the Premium Service. You will, however, lose the right to cancel if the service is fully performed during this cancellation period.

If you have purchased a document with Legal Review, the service will be fully performed when the Legal Review has been concluded by us.

You can cancel by sending us a message using the 'Contact Us' function in your Which? Wills account.

To meet the cancellation deadline, it is sufficient for you to send your communication concerning your exercise of the right to cancel before the cancellation period has expired.

We reserve the right to terminate the Premium Service agreement by giving you 60 days written notice. If we terminate the Premium Service, you will receive a full refund, less an appropriate deduction to reflect the provision of the Premium Service to you up until the point of cancellation. 

(ii) Limits on our responsibility and liability
We will not have any responsibility for the following:

(a) any delay in the delivery of your printed Document; and

(b) any information you provide to us that is used in the preparation, printing and binding and dispatch of your printed Document.

(iii) Data you provide relating to another person

If while using the Premium Service, you supply information about another person or other people you thereby confirm that you have their permission to pass their details, including any sensitive data to us, and for their details to be used in the production of the will, and that they are agreeable to us holding this information and data, and to process it in order to produce the Premium Service. The personal data you provide about another person or people will only be used in connection with the provision of the Premium Service and will be processed in accordance with our Privacy Policy.

(iv) Third party service providers

We may engage the services of third parties to provide or assist us in providing the Premium Service. You agree that we may pass on to such third parties that we engage for this purpose any data or information that you provide to us when using the Premium Service. By using or purchasing the Premium Service, you confirm that you have also obtained the consent of anyone else that you or any other party provide data and information about when using the Premium Service, to their data and information being passed on to a third party in the way described above.

(v) Variation

We may need to change these terms in the future. We will write to you with at least six weeks' notice if these terms are changing, so that you can decide whether to continue the Premium Service.
